सीटी नर्सरी, डीएड डिग्री धारकों को काउंसलिंग में शामिल करने का निर्देश





इलाहाबाद । सीटी नर्सरी डिग्री धारकों को 10 हजार सहायक अध्यापक की भर्ती और डीएड डिग्री धारकोें को 15 हजार सहायक अध्यापकों की भर्ती के काउंसलिंग में शामिल करने के हाईकोर्ट के आदेशों की सरकार अवमानना कर रही है। इस मामले पर शुक्रवार को प्रमुख सचिव बेसिक शिक्षा हीरालाल गुप्ता को हाईकोर्ट में उपस्थित होकर स्पष्टीकरण देना पड़ा। कोर्ट ने उनको आदेश के पालन का एक और अवसर दिया है। इस मामलों में दर्जनों अवमानना याचिकाएं हाईकोर्ट में दाखिल की गई हैं।

सीटी नर्सरी के मामले में ममता, माला यादव सहित तमाम अभ्यर्थियों ने याचिकाएं दाखिल कर कहा कि दस हजार सहायक अध्यापक की भर्ती की काउंसलिंग में सीटी नर्सरी डिग्री धारकों को शामिल करने का हाईकोर्ट से आदेश हो चुका है। इसके बावजूद उनको काउंसलिंग में नहीं शामिल किया गया। प्रमुख सचिव हीरालाल ने बताया कि इसके लिए एनसीटीई से अनुमति मांगी गई है। अनुमति मिलते ही आदेश का पालन किया जाएगा। याचिका पर सुनवाई कर रहे न्यायमूर्ति आरडी खरे ने चार सप्ताह में आदेश का पालन कर लेने को कहा है।

इसी प्रकार से डीएड डिग्री धारकों को 15 हजार सहायक अध्यापकों की भर्ती में शामिल करने का हाईकोर्ट ने निर्देश दिया था। इस आदेश का पालन नहीं होने पर सुमन पांडेय और 19 अन्य लोगों ने अवमानना याचिका दाखिल की है। कोर्ट ने प्रदेश के सभी बीएसए को दो सप्ताह में आदेश का पालन कर याचीगण को सूचित करने का निर्देश दिया है।

Learned counsel for the petitioner made a mention in the morning� that the matter is urgent as the last date of submission of� online application form is 20.2.2015, hence� the� record was� called from the office of the� Stamp� Reporter.�
Heard learned counsel for the parties.
The petitioner possessed the qualification of Diploma in Education i.e. D.Ed.� and claims to be eligible for appointment on the post of Assistant Teacher in the primary school. She is an applicant against the advertisements dated 12.12.2014 and 15.12.2014. The contention of the petitioner is that qualification possessed by her is the prescribed� qualification by the� NCTE.
By means of present writ petition, the petitioner has sought for� a direction to the respondents to consider the selection and appointment of the petitioner pursuant to the notification dated 9.12.2014 and advertisement dated 26.12.2014� issued for the selection and appointment� against 15,000 posts of� Assistant� Teachers.
Similar controversy came up before Division Bench of this Court in Special Appeal Defective No. 130 of 2014 Harsh Kumar & another vs. State f U.P. and four others connected with another Special Appeal No. 131 of 2014 Devendra Narayan Pandey and 11 others. It was observed that qualifications which have been prescribed by the NCTE in notification dated 29.7.2011 include two years Diploma in Education (Special Education) i.e. D.Ed. Once the qualifications have been prescribed by the NCTE, these would necessarily be binding and it is not open for the State Government to exclude (from the zone of eligibility). Consequently, Diploma in Education(Special Education) was held to be a qualification which is recognized for appointment on the post of Assistant Teacher for teaching class 1 to 5. A mandamus be issued directing the State Government to permit the appellants therein and such other persons who claim to be holding such qualification which are within the purview of the notification issued by NCTE on 23.8.2010 as amended on 29.7.2011, to apply for the post of Assistant Teacher for teaching class 1 to 5 which was subject matter of advertisement in question.
Learned counsel for the petitioner submits that Special Leave Petition filed in the Apex Court against judgment of this Court dated 5.2.2014 in Special Appeal Defective Nos. 130 of 2014 and 131 of 2014 was dismissed on 13.1.2015. Contention is that the petitioner possesses eligibility qualification as prescribed by NCTE in notification dated 23.8.2010 as amended on 29.7.2011 and hence the case is covered by the judgment of this Court in Harsh Kumar(supra).
Learned Standing Counsel appearing for respondent No.1 Prays for and is� allowed three weeks' time to file counter affidavit. One week thereafter for filing rejoinder affidavit.
List after four weeks.
In view thereof, a mandamus is issued to the respondents to accept the application form of the petitioner who claims to be holding the eligibility qualification as per notification issued on 23.8.2010 as amended on 29.7.2011 for the post of Assistant Teacher in the primary school(class 1 to 5) as against advertisement dated 12.12.2014/13.12.2014 i.e. advertisement in question.

The petitioner is holding D.Ed. (Diploma in Education) and has applied for the post of Assistant Teacher in Junior Basic School (Class I to V) as against the advertisement issued for appointment against 15,000 post of Assistant Teachers. He� has submitted On-line Application Form on 26.12.2014. It is stated that D.Ed. (Diploma in Education) is approved qualification for consideration as a training qualification for appointment on the post of Assistant Teacher by the NCTE vide notification dated 23.8.2010 as amended on 29th July, 2011. Submission is that the claim of certain candidates who had qualification of D.Ed. (Special Education) and cleared TET i.e. Teacher Eligibility Test came up for consideration before this Court determine their eligibility for appointment to the post of Assistant Teachers in Primary Schools in Special Appeal (Defective) No. 130 of 2014 (Harsh Kumar and another versus State of U.P. and 4 others) and another Special Appeal No. 131 of 2014 (Devendra Narayan Pandey and 11 others versus State of U.P. and otrhers). Both the appeals were allowed vide judgment and order dated 5.2.2014. The judgment of Special Appeal Bench, has been affirmed by the Apex Court in Special Leave to Petition(civil) No. 12060-12061 of 2014 which was dismissed on 13.1.2015.
The observations made in the case of Harsh Kumar and another versus State of U.P. and 4 others in paragraph '14' are as under:-
"In the circumstances, the special appeals would have to be allowed and are, accordingly, allowed. The impugned judgment and order of the learned Single Judge dated 14 November 2013 is set aside. A mandamus would, accordingly, issue directing the State to permit the appellants and such other persons who claim to be holding the qualifications which are within the purview of the notification issued by the NCTE on 23 August 2010, as amended on 29 July 2011, to apply for the post of Assistant Teachers for Classes I to V which was the subject matter of the advertisement in question."
The petitioner submits that the petitioner is holding same qualification and claiming parity with the qualification prescribed for the post of Assistant Teacher in the notification issued by NCTE, which is D.Ed (Special Education).
The matter requires consideration.
Sri R.A. Akhatar,� learned counsel has put in appearance on behalf of respondent no. 5, Sri Mrigraj� Singh, learned counsel for respondent no. 4 and learned Standing Counsel appears for respondent nos. 1 to 3 and 6.
All the respondents may file counter affidavit within three weeks.
One week, thereafter, for filing rejoinder affidavit.
List after four weeks.
In the meantime, the petitioner shall be allowed to appear in the counseling to be held for appointment on the post of Assistant Teacher in Junior Basic School on the Form submitted by him on 26.12.2014 and his candidature would be considered.
However, the appointment of the petitioner, if any, against the post of Assistant Teacher in Junior Basic School will be subject to the outcome of the writ petition.�
