Heard Shri Beerendra Singh Pal, learned counsel for the petitioner, Shri A.K. Yadav for the respondent no. 4 and the learned Standing Counsel appearing for the respondents no. 1, 2 and 3.
The petitioner belong to General (Male) category and the petitioner had participated in the Third round of counseling in District-Siddharthnagar. The petitioner claimed that his name appeared in the select list prepared after third round of counseling and his marks are higher than the cut-off of the merit list of his category. Despite that appointment letter has not been issued to the petitioner as the candidates having lesser marks than that of the petitioner have been allowed to participate in the fourth round of counseling and the entire result has been reshuffled.
Shri A.K. Yadav and the learned Standing Counsel appearing for respondents pray for and is allowed three weeks time to file counter affidavit. The petitioners shall have one week thereafter for filing rejoinder affidavit.

In the meantime, appointment letter be issued to the petitioner by the respective DIET after verification of their eligibility and after ascertaining the fact of appearance in the counseling as per their merit. It goes without saying that the appointment of the petitioners shall be subject to the result of this writ petition and Civil Appeal No. 4347/4375 of 2014 (State of U.P. & others versus Shiv Kumar Pathak) pending before the Apex Court.
It is made clear that the candidates to whom appointment letters have already been issued, will not be affected by this interim order.
