Heard Sri Ajay Subrat Singh, learned counsel for the petitioner and Sri Mohd. Shere Ali, learned counsel appearing for respondents no.3 and 5 and the learned Standing Counsel appearing for the State-respondents no.1,2 and 4.
The petitioner belongs to O.B.C. (Female) category and the petitioner had participated in the fourth round of counseling in District Shahjahanpur.� The petitioner claimed that her name appeared in the select list prepared after fourth round of counseling and her marks are higher than the cut-off of the merit list of their category. Despite that appointment letter has not been issued to the petitioner as the candidates having higher marks than that of the petitioner have been allowed to participate in the fifth round of counseling and the entire result has been reshuffled.
�Learned Standing counsel appearing for respondent Nos. 1, 2 and 4� and Mohd. Shere Ali, learned counsel appearing for respondents no.3 and 5� pray for and are allowed three weeks time to file counter affidavit. The petitioner shall have one week thereafter for filing rejoinder affidavit.
Connect with Writ-A No. 5001 of 2015.
In the meantime, appointment letter be issued to the petitioner by the respective DIET after verification of her eligibility and after ascertaining the fact of appearance in the counseling as per her merit. It goes without saying that the appointment of the petitioner shall be subject to the result of this writ petition and Civil Appeal No. 4347/4375 of 2014 (State of U.P. & others versus Shiv Kumar Pathak) pending before the Apex Court.
It is made clear that the candidates to whom appointment letters have already been issued, will not be affected by this interim order.
