Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents.� Shri Sunil Kumar Singh appears for respondent nos.3 to 5.
With the consent of learned counsel for the parties, the writ petition is being decided without calling for counter affidavit.�
By means of present writ petition, the petitioner has prayed for direction to the respondents to consider and issue an appointment letter for the post of Assistant Teacher against the vacancy advertised for trained teacher selection 2011 in Special Quota (EXS) category in Disrict Kushinagar.
It is submitted that the petitioner is ex-servicemen and as per UPTET 2011 has secured 83% marks and he also comes within the purview of cut off marks.�� It is submitted that the petitioner has made several applications in this regard but no action has been taken on his grievance.
Learned counsel for the petitioner precisely submits that the respondents be directed to consider the grievance of the petitioner within stipulated period of time.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the respondent no.4� to look into the grievance of the petitioner and pass appropriate order in accordance with law within a period of three weeks from the date of production of a certified copy of this order before him.
